Description
This two day course is a carefully integrated set of modules intended to develop the knowledge and skills that environmental professionals need to serve as environmental leaders for their organizations. Participants will better understand today's key environmental compliance issues, how to anticipate problems and plan for success. This course provides an overview of a broad range of federal and state environmental regulations, jurisdictions, regulatory compliance, and enforcement. The first day's material will focus on federal environmental regulations. The second day will focus on state environmental regulations, environmental standards, compliance, permitting, and enforcement.

Intended Audience: The course is intended for environmental professionals, private consultants, seeking an improved understanding of environmental regulations. Previous regulatory experience or knowledge is not required to benefit from this course.

About the Instructors
Bill Jarocki has been the Director of the Environmental Finance Center (EFC) located at Boise State University since 1996. He serves as an adjunct faculty member in the Master of Public Administration Program and the College of Engineering. The EFC specializes in the financial and management aspects of water and wastewater systems, and in watershed finance. Jarocki is an expert witness to the EPA's Environmental Finance Advisory Board. In 1995 and 1996, Bill directed Idaho's Drinking Water Protection Program as the interim Program Manager with the Idaho Department of Environmental Quality. Prior to joining the IDEQ, Bill served on the staff of the Association of Idaho Cities and was the AIC Executive Director from 1989 to 1992.

Dawn Blancaflor is an Associate General Counsel with Boise Cascade Company where she is responsible for ensuring overall environmental compliance for over 25 manufacturing plants including pulp and paper mills, forest product facilities, container plants and numerous building supply distribution locations throughout the United States, Canada and Brazil. From 1994 to 1996 she was an Associate Attorney with Lukins & Annis in Coeur d'Alene, assisting commercial and industrial clients on regulations of CAA, CWA, and CERCLA , and counseling agricultural interests on maintaining compliance with National Ambient Air Quality Standards. Dawn graduated cum laude from Gonzaga University School of Law, during that time she was an Legal Intern with the United States Attorney's Office for the Eastern District of Washington assisting with prosecuting violations of CAA, CWA, CERCLA and RCRA.

Course Outline

Day 1 - September 13, 2005

Session 1 - Overview of Environmental Compliance Issues/Successes

- Facilitated discussion with participants to improve understanding of the major environmental compliance issues facing environmental managers 
- Best practice environmental programs will be presented, and participants will have an opportunity to share key issues confronting them

Session 2 - Framework of Federal Environmental Laws
- National Environmental Policy Act (NEPA),
- Clean Air Act (CAA),
- Clean Water Act (CWA),
- Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA),
- Resource Conservation and Recovery Act (RCRA),
- Toxic Substances Control Act (TSCA),
- Solid and Hazardous Waste Laws,
- Superfund,
- Safe Drinking Water Act (SDWA),
- Emergency Planning and Community Right-to-Know Act (EPCRA),
- Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA),
- Endangered Species Act (ESA), and
- Other regulations - Civil liability, administrative penalties, and criminal sanctions 

- Penalty and information gathering authorities for federal environmental laws

- Implementation of federal environmental laws in Idaho

- Overview of primary federal agencies

- Regulatory authorities, methods of enforcement, and types of regulatory decision/appeal processes (i.e. hearings boards)

Session 3 - Framework of State Environmental Laws 
- Idaho Environmental Protection & Health Act ,
- Water Quality Act,
- Clean Lakes Act,
- Hazardous Waste Management Act (HWMA),
- State Hazardous Waste Facility Act,
- Hazardous Substance Emergency Response Act,
- Idaho Land Remediation Act,
- Water Rights and Reclamation Act,
- Smoke Management Act,
- Petroleum Clean Water Trust Fund Act, and
- Other Regulations - Civil liability, administrative penalties, and criminal sanctions
- Penalty and information gathering authorities for state environmental law
- Implementation of state environmental laws in Idaho
- Overview of primary state agencies
- Regulatory authorities, methods of enforcement, and types of regulatory decision/appeal processes

Session 4 -Environmental Standards and Compliance
- Discussion of the various types of environmental standards in air, water and hazardous waste laws
- Development of Best Available Technology
- Methods used to identify compliance with standards

Session 5 - Permitting and Enforcement
- Key steps in the permitting process. Evaluating the characteristics of effective permit applications
- Overview of the enforcement process
- Steps in planning and executing environmental inspections

Course Materials: Each attendee will receive a binder containing the course proceedings (slides, notes, and references).
